First application


How to apply

Application procedures and required documents:

  • Establishments to be set up in buildings under construction
    1. Complete application form for opening hotels and similar establishments【HS Model 101】 (forms can be downloaded from MGTO Industry Net or available from MGTO/MGSC/MGSC-I);
      NB: According to Article 34 of Decree Law no. 16/96/M dated 1st April, the names of the establishments should be in both Chinese and Portuguese, with the exception of hotels whose names are internationally recognized.
      Names in English or other languages may be included if necessary but please note that the meaning of these names should be basically compatible.

      1. If the application is made by a company, the relevant application form must be signed by the company’s lawful representative(s) according to the signature(s) on the identity document(s), with a copy of the representative(s)’ identity document(s) (front and reverse side on the same page) attached.
      2. If the application is made by an individual, he/she should sign the relevant application form according to the signature on the identity document, with a copy of the identity document (front and reverse side on same page) attached.
      3. If the applicant authorises others to make the application on his/her behalf, the original letter of authorisation with notarised signature(s), or a certified copy of such, must be submitted. Copy of the identity document(s) of the authorised person(s) must be enclosed (front and reverse side on same page).
    2. If the application is made by a company, an original certificate of company registration issued by the Commercial and Movable Property Registry within the past three months must be submitted;
    3. One original and six copies of the following documents must be submitted:
      1. Completed similar establishment (forms can be downloaded from MGTO Industry Net or available from MGTO/MGSC/MGSC-I).
      2. Location plan with appropriate proportions.
      3. A project plan in a scale of 1:1000 showing construction condition and relation to surrounding buildings (applicable only to hotels).
      4. Mezzanine levels in a scale of 1:100 in order that design facilities and their passageways as well as location of facilities can be appraised (areas for related facilities and passageways to be clearly indicated).
      5. For better understanding of the design plan, a cross-section and a longitudinal section are required. One of the sections should show the elevation entrances and exits;
      6. Elevation of every building in a scale of 1:100, facing materials and colour should be indicated.
      7. * Design plans for water supply, drainage, sewage disposal, power equipment, streets as well as exits and entrances.
      8. * Design plans for fire-fighting system.
      9. Memorandum of description and illustration of the project, including:
        1. Characteristics of building and compatibility with surrounding area;
        2. Overall fit-out and main features of building;
        3. Materials used for building, facing and decoration;
        4. General characteristics of establishment, special characteristics of public area and service area;
        5. Expected starting and completion date for project.
      10. A plan in a scale of 1:1000 in which plans of area without buildings, green area and entertainment area should also be included for easier appraisal of adopted method for managing the construction and landscape (applicable only to tourism complexes).
        Note

        1. These design plans “*” should be submitted the latest at the facilities’ inspection stage providing that a declaration##【G Model 701】 (forms can be downloaded from MGTO Industry Net or available from MGTO/MGSC/MGSC-I), DSSOPT issued receipt, C2 form with its index have been submitted to MGTO on this purpose.
          ## If applicant chooses a general application procedure instead, one original with six copies for documents listed under point 3 and a declaration【G Model 702】should be submitted to MGTO on this purpose. Forms can be downloaded from MGTO Industry Net or available from MGTO/MGSC/ MGSC-I).
        2. Design plans of all establishments must be drawn up by architects, civil engineers or technicians, in the field of electronic engineering or mechanical engineering, fire-fighting engineering companies, building contractors or construction companies, all registered with the Lands, Public Works and Transport Department (DSSOPT). All plans require signatures of applicants and relevant technicians.
        3. If the establishment is located on a classified immovable property (i.e. “monuments”, “buildings of architectural interest”, “building complex” or “sites”), a “to-be-classified immovable property” or in a buffer zone and a temporary buffer zone as defined by Law No. 11/2013 on “Cultural Heritage Protection Act”, an additional copy shall be submitted to the Macao Government Tourism Office for the purpose of seeking opinion from the Cultural Affairs Bureau.
      11. One copy of the M/1 business tax form from the Finance Services Bureau (DSF) can be submitted when applying for inspection of facilities.
    4. Original identity document of person submitting application form must be produced.
  • Establishments to be set up in constructed buildings with operating license
    1. Completed application form of opening hotels and similar establishments【HS Model 101】 (forms can be downloaded from MGTO Industry Net or available from MGTO/MGSC/MGSC-I);
      Note:
      According to Article 34 of Decree Law no. 16/96/M dated 1st April, the names of the establishments should be in both Chinese and Portuguese with the exception of hotels whose names are internationally recognized.

      1.       7. A copy of receipt and M6 form with its index issued by DSSOPT;
      8. Front view photo of every side of the building in size of 18cm x 24cm;
      9. Memorandum of description and illustration of project, including:
        1. Characteristics of building and compatibility with surrounding area;
        2. Overall fit-out and main features of building;
        3. Materials used for building, facing and decoration;
        4. General characteristics of establishment, special characteristics of public area and service area;
        5. Expected starting and completion date for project.
      10. Note

        2.     4. If the establishment is a bar or nightclub, designs for sound insulation and noise absorbents should be submitted, including design details, design plans, and technical parameters and manuals of relevant materials.
    5. One copy of the M/1 business tax form from the Finance Services Bureau (DSF) (can be submitted when applying for inspection of facilities).
    6. Original identity document of person submitting application form must be produced.

Fees

  1. Fee for inspection of facilities: MOP500.00;
  2. Fee for publishing license extract in the Official Bulletin of the Macao Special Administrative Region: MOP1,000.00 (Overpayment refundable; supplemental payment for deficiency);
  3. Fee for issuing licenses:
    1. Deluxe similar establishments: MOP12,500.00 (plus 10% stamp duty)
    2. First-class and second-class similar establishments: MOP7,500.00 (plus 10% stamp duty)

Place of application

  • Macao Government Tourism Office – Payment can be made by cash, cheque or bank draft (It should be made payable to “Direcção dos Serviços de Turismo”);
  • Macao Government Services Centre / Macao Government Services Centre in Islands – Payment can be made by cash, cheque or bank draft (It should be made payable to “Instituto para os Assuntos Municipais”)

Important information
According to Administrative Regulation no. 22/2008

  • Payment can be made by only one of the 3 means above in each payment;
  • Exact amount payable should be put on the cheque and bank draft;
  • The date on the cheque should be no more than 3 days prior to the date when payment is made.
  • The cheque should be certified if the payment is equal to or exceeding MOP50,000.00.

Time for processing

Examination and approval of 1st time license application and inform the interested party of the relevant result in the form of official letter: Within 25 working days counting from the day after MGTO receives favourable opinions from all the related technical departments. (Performance pledge)

Inspection of facilities in relation to 1st time license application: Within 14 working days counting from the day after the interested party submits the application and provides all necessary documents to MGTO. (Performance pledge)

Reimbursement of the remaining balance for the publication at Macao Official Gazette due to the issue of new licence: Within 15 working days counted from the following day after the full set of application and necessary documents are received. (Performance pledge)

Remarks/ application requirements

Please note:

  1. Recommendations for minimum requirement for sound insulation and noise absorbing equipment
  2. Applicants for hotels should apply for inspection of facilities within 18 months upon notice from MGTO regarding approval of application.
    Applicants for similar establishments should apply for inspection of facilities within 6 months upon notice from MGTO regarding approval of application. If a similar establishment is located in a hotel under construction, applicant can apply for inspection of facilities within 18 months upon notice from MGTO regarding approval of application.

  3. To be submitted upon application for inspection of facilities:
    1. Construction license;
    2. N1 – Notification of construction completion and a copy receipt; or a copy of project legalizing approval letter and a copy of tax payment receipt;
    3. Company rules and staffing chart (applicable only to hotels);
    4. The relevant fees.

Validity of license: One year.
