Remarks / Important notes on application
Important notes:
1.The period of right of use of an ordinary tomb is 7 years. Within 3 months before the expiry of the right of use of the tomb, the person concerned is required to make an application for exhumation to IAM and select a date within 6 months from the expiry date for the exhumation to be carried out, or an application for postponement of exhumation for a maximum of 1 year can be submitted to IAM together with valid reasons and explanation. (For example, if the deceased A was buried on 1 January 2020, the 7-year period of right of use of the tomb expires on 31 December 2026. The person concerned is required to make an application for exhumation to IAM between 1 October and 31 December 2026 and select a date between 1 January and 30 June 2027 for the exhumation to be carried out. If an application for postponement of exhumation is necessary, the person concerned is required to make an application to IAM between 1 October and 31 December 2026.);
2.In accordance with the stipulation of Clause 2 of Article 13 of the current Administrative Regulation no. 37/2003 “Regulations on Management, Operation and Supervision of Cemeteries”, the obligation to exhume the remains is required to be fulfilled in the period stipulated in Article 17 of the same Administrative Regulation. Otherwise, it is considered as abandonment of the relevant remains. In this case, IAM may cremate and handle the remains appropriately after exhumation according to its authority without further notice. If exhumation has been carried out according to IAM’s authority and the remains are available to be claimed, IAM can collect the payable fees and charges from the person claiming the remains, and recover any extra expenses paid;
3.If the person concerned does not fulfil the obligation to exhume the remains during the mentioned period and does not apply for postponement of exhumation, he/she is required to pay double the fee to IAM for extension of the right of use of the tomb for one year before the exhumation or postponement of exhumation can be carried out;
4. In terms of use of ordinary tombs, if the person concerned makes an application and it is proved that he/she is not financially capable to pay the fees, IAM may exempt the mentioned fees with the exception of the fees of license for works;
5.Tombs, bone boxes and ash boxes are required to be engraved with names that match the names stated on the identification documents of the buried persons. Engraving names unauthorised by IAM is prohibited
