Works and services in relation to tobacco prevention and control

Introduction

The Tobacco and Alcohol Prevention and Control Office operates under the Area of Community Health Care in the Health Bureau. Pursuant to the Administrative Regulation No. 26/2023, it shall exercise the following functions and powers:

Terms of reference

  • To propose the guiding principles of policies to prevent smoking and the consumption of alcoholic beverages, in accordance with recommendations issued by international organizations.
  •  To coordinate joint operations to control smoking and the consumption of alcoholic beverages by minors;
  • To provide support to the entities responsible for places where smoking is prohibited and where the sale, supply and consumption of alcoholic beverages are prohibited, ensuring compliance with legislation regarding the prevention and control of smoking and the prevention and control of alcoholic beverage consumption by minors;
  •  To monitor the ingredients of tobacco products intended for public consumption;
  • To promote health information and educational campaigns related to the harmful effects of tobacco and alcoholic beverage consumption, as well as the significance of smoking cessation and the treatment and rehabilitation of alcohol dependence;
  • To disclose the ingredients used in the manufacturing of tobacco products and their respective quantities to consumers;
  • To propose and promote measures aimed at preventing and controlling smoking and the consumption of alcoholic beverages by minors, and evaluate the outcomes of their implementation;
  • To prepare follow-up and evaluation reports on tobacco consumption and the consumption of alcoholic beverages by minors;
  •  To process the sanctioning procedures initiated in response to the enforcement of legislation regarding the prevention and control of smoking and the prevention and control of alcoholic beverage consumption by minors.
  •  To monitor compliance with legislation relating to the prevention and control of smoking and the prevention and control of alcoholic beverage consumption by minors.

  1. Reporting violations: Anyone
  2. Legal enquiries: Anyone
  3. Promotional activities enquiry: Interested schools/ educational institutions/ associations/ enterprises
  4. Request for publicity materials: Anyone
  5.  Payment of fines: Individuals who are fined for breaches of the tobacco or alcohol control law
  6. Access to penalty files: The offender (individual / premises owner) or their representative
  7. Administrative appeal against prosecutions/penalties: The offender (individual / premises owner) or their representative

Service Outcomes

  1. Reporting violations: Follow-up actions will be taken as appropriate
  2. Legal enquiries: Clarifications will be provided on current tobacco and alcohol control laws
  3. Promotional activities enquiry: Staff will be assigned to conduct tobacco or alcohol control activities
  4. Request for publicity materials: Relevant publicity materials will be provided
  5. Payment of fines: A receipt (or e-receipt if the fine is settled online) will be issued upon completion of payment
  6. Access to penalty files: Applicant will be permitted to inspect the case files related to themselves
  7. Administrative appeal against prosecutions/penalties: Result of appeal will be sent to the appellant
