The Primary Court of the Macao Special Administrative Region delivered its judgment yesterday in the national security case involving former legislator Au Kam San. The Legislative Assembly firmly supports the judicial organs in independently rendering the ruling in accordance with the law, and considers that the trial fully embodies the spirit of the rule of law. The Legislative Assembly expresses strong dissatisfaction with and resolutely opposes the unwarranted comments and malicious attacks on Macao’s legal principles made by the European External Action Service, the Congressional-Executive Commission on China of the USA, the Office of the United Nations High Commissioner for Human Rights, and certain members of the European Parliament.
In Macao, no one is above the law. Any act that challenges the fundamental state system established by the Constitution, undermines the constitutional order as defined by the Constitution and the Macao Basic Law, or violates the Law on the Maintenance of National Security, must be severely punished in accordance with the law. As a former member of the Legislative Assembly, Au Kam San was expected to strictly abide by the law and uphold his oath of office. However, he long engaged in collusion with overseas organizations and, during the performance of his duties, disclosed confidential information obtained from closed-door Legislative Assembly meetings to foreign entities. Such acts clearly violate legal provisions and must incur corresponding legal consequences.
Macao’s judicial system is explicitly protected under the Basic Law, and courts independently exercise adjudication power free from interference. The trial of Au Kam San’s case strictly followed the Law on the Maintenance of National Security and other applicable legal provisions, with full protection afforded to the suspect’s procedural rights throughout the process. Any remarks or actions that attack, pressure, or undermine the SAR’s lawful judicial proceedings constitute a serious violation of the rule of law.
The Legislative Assembly emphasizes that the Au Kam San case is purely an internal affair of the Macao SAR. No external force has the right to interfere. The Legislative Assembly once again urges relevant countries and institutions to respect China’s sovereignty and immediately cease all acts of interference in China’s internal affairs and the internal matters of the Macao SAR.
