Formalities and Required Documents

  1. Application letter for “Operating Licence of Regular Maritime Passenger Transport Activities” (self-written) should be addressed to the Director of Marine and Water Bureau. It must be signed by a person with binding power over the applicant and his/her identity and signature must be notarised.
  2. The application must be submitted with the following documents:
    1. the applicant’s duly updated and certified Commercial registration certificate, issued by the Commerce and Movable Property Registry. If the company is established outside of Macao SAR, documents with the same validation must be attached (If the Commercial registration certificate is issued by the Commerce and Movable Property Registry of Macao SAR, and of which information can be obtained online from the Legal Affairs Bureau , applicants are not required to submit the Commercial registration certificate);
    2. documents proving the capital of the company has been fully paid or allocated for the operation of business in Macao SAR;
    3. list of members of the board and managers, as well as the supervisory body, if any, of the applicant;
    4. if the applicant is established outside of Macao SAR, identification of the appointed representative must be attached;
    5. certificates of criminal record of the applicant’s administrators or of the designated representative, issued by the competent entities located in their respective workplace (If the certificate of criminal record is issued by Identification Bureau of the Macao SAR Government, the applicant can apply via the Identification Services Bureau’s website, service counter or self-service kiosk and choose to have it posted to the Marine and Water Bureau);
    6. curriculum vitae of each of the management staff, together with supporting documents of maritime qualifications and professional experience, when the applicant is established outside of Macao SAR;
    7. certified copies of contractual documents of the management company of vessels, if any;
    8. supporting documents of professional qualifications of crew and cabin crew;
    9. balance sheet of the applicant’s last 3 fiscal years, if any;
    10. any other information which the applicant considers relevant to consideration of the application.
  3. The proposal should include the following:
    1. estimated commencement date of business;
    2. a ferry terminal or more of Macao SAR as a port of departure, transit or destination;
    3. ferry routes for operation;
    4. estimated passenger flow of each ferry route;
    5. sailing schedule of each ferry route;
    6. tariff table for each ferry route;
    7. number of vessels for each ferry route;
    8. information of each vessel in operation, including name, port state, ship model, gross tonnage, registration number of IMO, ship owner, passenger capacity and if any, ship management company;
    9. documents which prove the vessel capable of operating on a permanent and stable basis;
    10. safety and rescue plan which safeguard the crew and vessels during tropical cyclones;
    11. contingency plan for tackling emergencies happening during sailing and in the ferry terminals;
    12. allocation plan of staff which provides logistics support to the ferry terminals in Macao SAR;
    13. infrastructures and other facilities which need to be installed and used for the operation of business in the ferry terminals of Macao SAR, with other purposes of use stated;
    14. documents of consent, issued by jurisdictional entities other than Macao SAR, which permit related ferry routes to open.

Documents required to be processed / applied in advance:

  1. notarisation of the signature of the person with binding power;
  2. certified copy of Commercial registration certificate, issued by the Commerce and Movable Property Registry (If the Commercial registration certificate is issued by the Commerce and Movable Property Registry of Macao SAR, and of which information can be obtained online from the Legal Affairs Bureau , applicants are not required to submit the Commercial registration certificate);
  3. documents proving the capital of the company has been fully paid or allocated for the operation of business in Macao SAR;

Notes: For the complete examination of the application, the applicant must provide clarification or additional documents that are necessary in accordance with the requirements of the Marine and Water Bureau.

Charges

Application Fees

Fees levied according to the Dispatch of Chief Executive No. 415/2009:

  • Issuance of Licence: MOP 20,000.
  • Issuance of Ferry Route permit: MOP 10,000 (each route permission).

Notes: By cash, bank draft or certified cheque (Bank draft and certified cheque are payable to the “Direcção dos Serviços de Assuntos Marítimos e de Água”.)

Deposit

The amount of deposit is 20% of the capital of the company or the allocated capital, if the operator is established outside of Macao SAR.

  • Operators must ensure full compliance with the obligations of operating maritime passenger services by providing deposits to the Macao SAR and settling all necessary fines.
  • The deposit is provided after issuance of the licence until the day prior to the commencement of operation.
  • The deposit can be paid by cash, bank guarantee or performance bond, on first demand.

Processing Time

90 days upon receipt of application.

Notes:

  • If the operators are requested for clarifications or additional documents, the period referred in the preceding paragraph shall be counted from the day of submission to the Marine and Water Bureau.
  • For clarification or resubmission of documents: the applicant will be notified within 15 days upon receipt of application. (Performance Pledge)
  • The processing of application for implementing special fares or other promotional offers: a reply will be given within 15 days upon submission of all necessary documents. (Performance Pledge)

Notes for Application

  1. Criteria for operating regular maritime passenger transport
    Pursuant to Administrative Regulation No.34/2009, entities which meet the following requirements can only be granted the licence to operate regular maritime passenger transport services:

    1. companies with maritime passenger transport as their major business;
    2. companies established in the MSAR or which have an appointed representative, according to the Commercial Law, when established outside of MSAR;
    3. when legally established in the MSAR, its capital, fully paid, should not be less than MOP10,000,000;
    4. when legally established outside of MSAR, its transferable capital should not be less than MOP10,000,000;
    5. provide the adequate qualifications and credibility of operating regular maritime passenger transport services;
    6. demonstrate to be financially, technologically and professionally capable;
    7. operators must incorporate at least two supervisors with senior maritime qualifications and more than two years of management experience.
  2. The licence is valid for 10 years from the date of issuance and is renewable for the same period, on condition that the applicant proves to fulfill the requirements of operating related services.
  3. The operation of maritime passenger transport services which take the ferry terminals of MSAR as a port of departure, transit or destination is subject to obtaining approval from the Marine and Water Bureau. Entities granted with an operation licence of maritime passenger services may apply for a new ferry route from the Marine and Water Bureau. Application for operation licence of ferry routes must be attached with a proposal prepared according to the abovementioned requirement No.3, with necessary arrangements. All ferry routes should commence operation within 180 days from the date of notification of approval, and are subject to revocation of the permit.
